for a permanent injunction and other relief in this matter pursuant to Section 13of the

Commission Act ("FTC Act"), 15 U.S.C. § 53, alleging violations of Sections 5 of the FTC Act,

and pursuant to New York's Executive Law (NY Exec.

Business Law (NY GBL) Article 22-A, §§ 349 and 350, respectively, and the parties having
