               1.        This case arises from Northwest Airlines Corp. and Northwest Airlines,

      (collectively "Northwest Airlines" or "Defendant") refusal to permit Arshad Chowdhury to board

      Flight 342 at San Francisco International Airport on October 23, 2001, because of Mr.

      Chowdhury's race, color, religion, ancestry, and/or national origin.  Mr. Chowdhury brings
