                      SEAN  MCCLUSKEY,                being  duly  sworn,  deposes and  says that 
Deputy  United  States Mar&al  with  the United  States Marshal's  Service,  and charges  as
fdIows:

                                                     COUNT  ONE

                      1.      From  on or  about  December  6,2001,  through  and including  on or
about  February  12, `zOO2, &I the  Southern  District  of New  York,  STEVEN  CHIN
LEUNG,  the  defendant,  having  been  released  on bail  in  conuection  with  aa offense
punishable  by  a maximum  term  of impriisonment  of S years and mare,  did  unlawfully,
wilfully,  und  knowingly  fail  to  appear before  a conrt  as required  by the  conditions  of
release,  to  wit,  STEVEN  CHIN  LJeUNG  failed  to  appear  for  a pretrial  conference  in
United  States  v.  Stevep  Chin  Leung  01  Cr,  815 (DC),  on December  6,2001,  or at &ry
time  thereafter.

impede, aad endeavor to influence, obslxuct, and impede, the due administration of
justice, to wit, while on release pursuant to an order of the United States District Court
